Things to Consider Before Taking Your Case to the Court

Very often my clients have requested me to take their case to court.

There are at least two sides to every story and often even more. Lack of communication brings distress and often people feel that court action is the only pathway to settle their matter. However, I believe that starting litigation must always be the last resort as no court case can be predicted with certainty.

When considering going to court I believe the following must be considered:

1. You must have a specific loss;
2. Can it be calculated in dollar value or not?
3. Do you have evidence either physical or electronic, or is it just one person’s word against another?
4. Is the relationship beyond repair or worthy of keeping?
5. Is your loss worth the stress, time and money required to pursue your case in court?

Court proceedings usually consume large amounts of time, money and stress. For the uninitiated, it can be like walking into a quagmire, resulting in more losses than gains, despite having a good case and winning. My first move is to try to settle the case and discover a compromise which both parties can live with. No matter what, when you go to court no one will end up happy. Whilst you may win your case but that may be at the cost of time better spent with your job or family. Going to court is a stressful enterprise where you can never know exactly what may happen or the evidence the defendant may produce to counter your version of events.
