Always Read Documents and Have Them Fully Explained Before Signing by An Independent Advisor


 


The relationship between child, parent and society is pivotal to how people treat each other.

It is a virtue of respect that has been expressed for millennia in every society. In more general terms, filial piety means to be good to one's parents; to take care of one's parents; to engage in good conduct not just towards parents but also outside the home so as to bring a good name to one's parents and ancestors; to show love, respect and support; to display courtesy to all. Unfortunately, I have had some clients where their spouse or children has not displayed filial piety.

Case 1.
My client who was in a nursing home was suffering with terminal cancer when her daughter brought in some documents for her to sign. My client was very weak and signed the documents. Fortunately, my client recovered and had a friend request me to visit her in the hospital. My client told me that she believes that she had signed some documents but her daughter does not return her telephone calls. As a precaution I drafted a will to represent my client’s wishes and had it properly witnessed according to law. Regretfully, several days later I was contacted by her family to advise of my client's death. They told me they were disappointed and bewildered that their mother had left everything to their youngest sister. I was able to give them the will that I had drafted which was the latest will giving to each of the children equally.

Case 2.
My client who is a foreign national had no knowledge of English whilst her son has become an Australian citizen. My client hopes to retire here in Australia and has bought a property in Sydney. Her son and girlfriend just before settlement convinced my client to grant them a small interest in the property. They took my client to their lawyer to sign documents to allow this to happen. My client, trusting her son, attended the lawyer’s office of her son’s girlfriend. She was presented with a document which was presented to her as a document providing the girlfriend with a small portion of the property, equal to her financial contribution towards the deposit. She was later to discover that the document that she signed was a mortgage with excessive interest and time provisions.

All these matters are able to be rectified but at considerable costs. It is always necessary to read the document or have a certified translation if you do not understand English and obtain independent legal advice regarding any document you need to sign. A solicitor cannot have a lender and borrower as their client.
