Hello everyone,

“Electronic witnessing of Documents”

With social distancing, many are fearful of venturing out to undertake such necessary things as preparing enduring powers of attorney, enduring guardianship and wills.

On Wednesday the government enacted the Electronic Transactions Amendment (COVID-19 Witnessing of Documents) Regulation 2020. This amendment now means that I am able to draft and witness via an audio-visual link such as Facetime, Skype, Zoom or other audiovisual services, the following documents:
(a) a will;
(b) a power of attorney or enduring power of attorney;
(c) a deed or agreement;
(d) an enduring guardianship appointment;
(e) an affidavit, including an annexure or exhibit to the affidavit; and
(f) a statutory declaration.

I must properly identify you and personally observe the signing of the document. This amendment, however, does not apply to notarial services and I remain available in my office to provide notarial services for my clients. I am also available after hours at Riverwood if required.
